Property settlements are final in the State of Texas and can not be modified even by agreement. The Court, however, retains jurisdiction to modify any and all provisions relating to a child until the child turns 18 or graduates high school whichever is later. Typical modifications include custody, child support and possession and access.

Modifications:

Modifications most commonly involve child custody, visitation, and child support. The requirement for almost any modification is that material change of circumstance take place between the last court hearing and the modification. Meaning, there is a basic change in the lives of the parents or children, which makes a modification of the terms of the divorce desirable. There are some changes to the divorce that are significant but are not considered modifications. For example, if one party were to hide a sum of money so that it will not become part of the divorce settlement. In this case, if the other party is able to locate this money, he or she can petition the court to reopen the case and take the found money into consideration of the total settlement.
