The most often used statistic that most marriages end in divorce has been reduced over the last few years, but still the divorce rate in America is more than twice what it was 40 years ago. In the most recent reporting period in Texas, 72,455 divorces were finalized in the state. This number is second to Florida among states reporting divorces and equals almost 200 divorces each day. Divorce is an overwhelming experience for those parents and children going through the process. Divorce:

There are two ways to handle a divorce in Texas: contested or uncontested. An uncontested divorce is where the parties reach an agreement on all the issues including children and the division of community property and debt. An uncontested divorce normally takes 75 days to finalize after the initial filing and is much cheaper than a contested divorce. A contested divorce is where the parties cannot reach an agreement on all the issues and thus Court intervention is required. If you know your divorce is going be contested the first step is to request temporary orders so each party knows what his/her rights and duties are regarding the children and property while the case is pending. Temporary orders are extremely important in cases where one spouse has access to all the money. At a temporary orders hearing the Court can order one spouse to pay the other spouse to pay temporary spousal support, child support and attorney fees. The Courts are required to level the playing field in that it is in the best interests of the children or even in property cases that both parties have an attorney.
